Basically yes, there is truth in the claim.
The case came to court at Liverpool Assizes in June, 1936. The promoter at Liverpool Stadium, William Bankier, had questioned the legitimacy of Sherry and Garnon's World Heavyweight Championship contest in the programme of June 28th, 1935, “The prices are as low as 6d. All I can say is that 6d is much more than it is worth. The impertinence of billing this as the world's championship is certainly going a bit far, and if there is any blame to be attached I should say that Oakeley, Sherry and Garnon are to be blamed …... Sherry has never been champion of the world and never will, as there are several men in America who could hold Sherry, one of these being Strangler Lewis.”
Garnon and Sherry sued Bankier, Pylon Publishing and Liverpool Stadium for libel. Garnon and Sherry won their case and received £300 and £800 damages respectively. In his summary before declaring judgement in favour of the two wrestlers the judge declared wrestling was a sport and the participants reputation was as valuable as that of a doctor or any other professional. Bankier lost an appeal against the decision.
Reports of the hearing do not state any claim of Sherry actually beating Lewis for the title. Sherry said he became champion by default because Strangler Lewis was not there to oppose him. At the appeal an affidavit from Lewis said he had met Sherry four or five times in the previous fifteen years and won every time. The judge dismissed this appeal because the defence had not had the foresight to bring it to the court's attention during the initial trial.
